These terms of sale are entered into on one hand by the company SMITH FLEURETTE, whose registered office is located at 10, rue Strauss Durkheim, 67000 Strasbourg, registered with the Trade and Companies Register of Strasbourg under number 498 632 231 00011, hereinafter referred to as 'SMITH FLEURETTE' and managing the website www.smithfleurette.com, and on the other hand, by any natural or legal person wishing to make a purchase via the website www.smithfleurette.com, hereinafter referred to as 'the buyer'

Article 1. Purpose

These terms of sale aim to define the contractual relations between SMITH FLEURETTE and the buyer, as well as the conditions applicable to any purchase made through the website www.smithfleurette.com. The acquisition of a product through this site implies an unconditional acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares, on one hand, that the purchase of products on the website www.smithfleurette.com is unrelated to their professional activity and is limited to strictly personal use, and, on the other hand, that they have full legal capacity, allowing them to commit to these general terms of sale.

SMITH FLEURETTE reserves the right to modify these terms of sale at any time in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the buyer's order.

Article 2. Products

The products offered are those listed on the website www.smithfleurette.com by SMITH FLEURETTE, subject to availability. SMITH FLEURETTE reserves the right to modify the product range at any time. Each product is presented on the website with a description that includes its main technical characteristics (size, capacity, use, composition, etc.). The photographs are as faithful as possible but do not bind the Seller in any way. The sale of products presented on the website www.smithfleurette.com is intended for all buyers residing in countries that fully permit the entry of these products into their territory.

Article 3. Prices

The prices listed on the product sheets of the internet catalog are in Euros (€) and include all taxes (VAT) applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. SMITH FLEURETTE reserves the right to modify its prices at any time, with the understanding that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased, based on the total amount of the order. In metropolitan France, the shipping fee charged to the buyer is €10 including VAT per ordered bag. For the rest of the world, the shipping fee charged to the buyer is €25 including VAT per ordered bag.

Article 4. Order and Payment Terms

Before placing an order, the buyer must create an account on the website www.smithfleurette.com. The account creation section is accessible directly from the menu bar. On each visit, if the buyer wishes to place an order or check their account (order status, profile, etc.), they must log in using this information. SMITH FLEURETTE offers the buyer the option to order and pay for products in several steps, with three payment options to choose from:

  • Payment by check: The buyer selects the products they wish to order in the "cart," makes any necessary changes (quantities, references, etc.), verifies the delivery address or provides a new one. Then, shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by check." Finally, the last step asks the buyer to review all the information, read and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm the order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer will receive an order confirmation indicating the registration of their order. To complete the payment and initiate the processing of the order, the buyer must print this order confirmation, accompanied by a check made out to "SMITH FLEURETTE," and send it to the following address: SMITH FLEURETTE, 10 rue Strauss Durkheim, 67000 Strasbourg. No cash payment should be sent. Only checks issued by a French bank will be accepted. Upon receipt of the check, the order will be processed, and the buyer will be informed by email. SMITH FLEURETTE will ship the products no later than 2 business days after the check corresponding to the order is cleared, subject to availability.

  • Payment by bank transfer: The buyer selects the products they wish to order in the "cart," makes any necessary changes (quantities, references, etc.), verifies the delivery address or provides a new one. Then, shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by bank transfer." Finally, the last step asks the buyer to review all the information, read and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm the order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer will receive an order confirmation indicating the registration of their order. To complete the payment and initiate the processing of the order, the buyer must contact their bank to make the transfer corresponding to the amount of their order to SMITH FLEURETTE's bank account, the details of which will be provided to the buyer. Upon receipt of the transfer, the order will be processed, and the buyer will be notified by email. SMITH FLEURETTE will ship the products no later than 2 business days after receiving the transfer corresponding to the order, subject to availability.

  • Secure payment via PayPal: The buyer selects the products they wish to order in the "cart," makes any necessary changes (quantities, references, etc.), verifies the delivery address or provides a new one. Then, shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment via PayPal." The next step invites the buyer to review all the information, read and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm the order by clicking the "Confirm my order" button. Finally, the buyer will be redirected to the secure PayPal interface to securely enter their PayPal account details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment via a PayPal account is irrevocable.

  • Secure payment by credit card (via the PAYZEN system): The buyer selects the products they wish to order in the "cart," makes any necessary changes (quantities, references, etc.), verifies the delivery address or provides a new one. Then, shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by credit card." The next step invites the buyer to review all the information, read and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm the order by clicking the "Confirm my order" button. Finally, the buyer will be redirected to the secure PAYZEN interface to securely enter their personal credit card details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer can demand the cancellation of the card payment, and the amounts paid will be credited or refunded. The cardholder's liability is not engaged if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank fees that may have been incurred, the cardholder must contest the debit in writing with their bank within 70 days of the transaction, or within 120 days if the contract with the bank allows for it. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the cardholder's written dispute. No fees for reimbursing the amounts will be charged to the cardholder.

The confirmation of an order implies acceptance of these terms of sale, recognition of having perfect knowledge of them, and renunciation of the buyer's own terms of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, SMITH FLEURETTE will communicate the order confirmation to them by email.

Article 5. Retention of Ownership

SMITH FLEURETTE retains full ownership of the products sold until full payment, including principal, costs, and taxes, is received.

Article 6. Right of Withdrawal

In accordance with Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed-upon geographical area. Orders are fulfilled by La Poste via COLISSIMO, a delivery service with tracking and delivery without signature. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract can be terminated, and the buyer will be refunded. SMITH FLEURETTE may provide the buyer with the tracking number of their package by email. The buyer is delivered to their home by their mail carrier. In case of the buyer's absence, they will receive a delivery notice from their carrier, allowing them to pick up the ordered products at the nearest Post Office, within a time frame specified by postal services. The risks related to transport are the responsibility of the buyer from the moment the items leave the premises of SMITH FLEURETTE. The buyer is required to check, in the presence of the La Poste representative or the delivery person, the condition of the packaging of the merchandise and its contents upon delivery. In case of damage during transport, any claims must be made to the carrier within three days from the date of delivery.

Article 8. Warranty

All products supplied by SMITH FLEURETTE benefit from the legal warranty provided for by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it can be returned to SMITH FLEURETTE, which will take it back, exchange it, or refund it. All complaints, exchange or refund requests must be made by post to the following address: SMITH FLEURETTE, 10 rue Strauss Durkheim, 67000 Strasbourg, within thirty days after delivery.

Article 9. Liability

SMITH FLEURETTE, in the distance selling process, is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other involuntary issues.

Article 10. Intellectual Property

All elements of the website www.smithfleurette.com are and remain the intellectual and exclusive property of SMITH FLEURETTE. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site, whether in the form of photos, logos, visuals, or text.

Article 11. Personal Data

SMITH FLEURETTE undertakes to preserve the confidentiality of the information provided by the buyer, which they may transmit for the use of certain services. Any information concerning the buyer is subject to the provisions of Law No. 78-17 of January 6, 1978. In this regard, the internet user has a right of access, modification, and deletion of information concerning them. Article 12. Dispute Resolution

These conditions of distance selling are subject to French law. For any disputes or legal issues, the competent court will be that of Strasbourg.

The European Commission provides an online dispute resolution platform (ODR). This platform is available at http://ec.europa.eu/consumers/odr/. As a customer, you always have the option of contacting the European Commission's arbitration board. We are neither willing nor obliged to participate in a consumer arbitration procedure.
